The National Supervisory Commission and the Discipline System

The merged discipline and supervision structure connects internal Party investigation with state supervisory power over public personnel.

In 2018, the Party discipline system acquired a state institution

Constitutional amendments in 2018 placed the National Supervisory Commission in China's state structure. The commission shares offices and leadership with the Central Commission for Discipline Inspection. One organization can use internal Party discipline and state supervisory authority. Its reach extends beyond CCP members to public personnel who exercise public power. [1]

Formally, the National Supervisory Commission is created by and responsible to the National People's Congress and its Standing Committee. Organizationally, it shares leaders, personnel, and offices with the CCDI, which operates under the CCP constitution and Party center. [3] An internal Party body can therefore use state powers against a wider population, while the form of a state institution gives Party control legal authority.

A case moves between Party discipline and criminal law

Investigators first determine whether a person falls under supervision, then obtain records, question people, and use supervisory measures. When the subject is a Party member, discipline review and state investigation can proceed together. The system may impose Party or administrative punishment before transferring suspected crimes to the procuratorate. By the time a court receives the case, the decisive period of confinement, questioning, and evidence production has often occurred inside the discipline-supervision system.

Merging the bodies makes investigation efficient. Personnel need not pass a case repeatedly between Party and state offices, and the center can drive major inquiries through a vertical discipline hierarchy. The same concentration removes external checks. Investigators shape the political characterization, control detention and evidence, and recommend punishment. During the early stage, a subject lacks the access to counsel and open proceedings associated with ordinary criminal procedure.

The 2023 Party and state institutional reform plan again strengthened centralized Party leadership in major fields. [2] The National Supervisory Commission did not become an anti-corruption body independent of the CCP. It became the institutional interface through which the Party commands state supervision.

Anti-corruption power disciplines the bureaucracy

The system prosecutes real corruption. The political problem lies in who selects cases, controls disclosure, and sets the pace. Independent journalists cannot freely trace networks that the Party declines to investigate. Opposition legislators cannot demand an inquiry into the ruling leadership. Courts cannot review why the Party center chose a person for discipline.

Anti-corruption thus punishes theft and trains obedience at the same time. Every public employee knows that property, relationships, and official conduct may enter supervision, while the decision to open an investigation lacks independent review. The top leadership can intimidate the bureaucracy and describe political loyalty as lawful supervision.

The state constitution establishes the commission's formal status and relationship to the NPC. The Party constitution establishes the CCDI's political hierarchy. Public texts do not reveal every internal instruction in a case. They do establish the institutional choice: the CCP did not give anti-corruption to an independent judiciary. It expanded the Party discipline apparatus across the state personnel system.
